1. Acceptance of Terms
By accessing this website, placing an order, or commissioning a design or engraving service from NiCs JaM ("we," "us," "our"), you ("Customer," "you") unconditionally agree to be bound by this Legal Notice and Terms of Service.
2. Intellectual Property & Design Ownership
  • Proprietary Designs: All original designs, graphics, text, templates, and concepts created by us remain the exclusive intellectual property of NiCs JaM. No transfer of intellectual property rights occurs upon sale unless explicitly agreed upon in a signed, separate written contract.
  • Customer-Submitted Media: By uploading, emailing, or providing logos, artwork, images, or text for custom engraving, you warrant that you own the copyright or have express, legal permission to use and reproduce the submitted materials.
  • Indemnification: You agree to indemnify, defend, and hold harmless NiCs JaM from any legal claims, liabilities, or expenses (including attorney fees) arising from claims of copyright or trademark infringement related to materials you provide. We reserve the right to refuse any design that we suspect violates third-party intellectual property or contains hate speech, profanity, or illegal content.
3. Custom Engraving Variations & Layout Approval
  • No Digital Proofs: We do not send digital proofs or mockups to customers prior to engraving. All orders are engraved exactly as submitted by the customer at checkout or via communication. By placing an order, you grant our artisans full creative discretion to format, scale, and align your submitted text or design to best fit the chosen product.
  • Customer Responsibility: You accept full responsibility for verifying the accuracy of all layouts, spelling, punctuation, capitalization, and formatting at the time of order submission. We are not responsible for errors submitted by the customer.
  • Material Disclaimers: Engraving involves natural materials (such as wood, leather, stone, or glass) and coated metals. You acknowledge that natural variations in wood grain, color shading, knots, and texture are inherent to these mediums. We do not guarantee a perfectly uniform appearance, and minor variances from product photographs are not considered defects.
4. Limitation of Liability
To the maximum extent permitted by law, NiCs JaM shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products, delayed shipments, or engraving errors. Our total liability for any claim shall not exceed the actual purchase price paid by the customer for the specific item in question.
5. Governing Law & Jurisdiction
This Legal Notice and any disputes arising out of your relationship with us shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to this business must be brought exclusively in a state or federal court located in Maryland.
